One of the more frustrating aspects of litigation is the enforcement of judgments. You may have been elated by the entry of a large judgment against your adversary, only to find that the judgment, standing alone, does you no good at all. Perhaps you enlisted the assistance of a "collection" firm, only to find that the firm may be competent to handle the simplest of cases, but has neither the desire nor temperament to pursue a determined defendant intent on avoiding enforcement of your claim.
To effectively pursue enforcement of a judgment, the judgment creditor must do more than simply serve a few restraining notices on bank accounts long since depleted. The judgment creditor must be prepared to aggressively pursue a judgment debtor by:
- Pursuing any and all fraudulent conveyances.
- Determining whether or not other entities or individuals are responsible for the debt of the judgment debtor.
- Tracking the surreptitious transferences of assets.
- Engaging in relentless and aggressive enforcement of the judgment through supplementary proceedings.
Most lawyers shy away from this kind of work. We don't. We have found that only through a committed prosecution do judgment creditors find success. The simple fact is that collection firms often engage in predictable and easily evaded efforts and then lose interest if their initial efforts do not bear fruit.
Make no mistake: There are times when a judgment debtor is genuinely judgment proof, either due to inadequate funds or by virtue of a "bullet proof" shield, in the form of corporate or business limited liability.
But frequently, there are funds or assets which can be applied to satisfy a judgment, provided that you enlist the assistance of a firm who is willing to engage in the tedious pursuit of such funds.
